1. Service Agreement
A written Service Agreement will be developed with each participant to clarify:

The supports to be provided

The cost of services

The scheduling and delivery expectations

Rights and responsibilities of both parties
All agreements will comply with the NDIS Code of Conduct and reflect person-centred, culturally sensitive support planning.

3. Provider Responsibilities
We commit to:

Deliver services professionally, competently, and ethically

Comply with the NDIS Practice Standards and Code of Conduct

Employ qualified and trained staff, including Registered Nurses and support workers

Respect your dignity, culture, values, and beliefs

Uphold your legal and human rights
4. Privacy and Confidentiality
We adhere to the Australian Privacy Principles (APPs). Personal information is collected only when necessary and used solely for providing services. Your data is stored securely and is only shared with your consent or when legally required.

5. Feedback and Complaints
Participants are encouraged to provide feedback. Complaints can be made verbally or in writing. We aim to resolve all complaints promptly, respectfully, and without retaliation.
Unresolved issues can be directed to the NDIS Quality and Safeguards Commission.
6. Changes to Services
Participants will be informed in writing of any significant changes to the availability or structure of services. We also ask that participants provide reasonable notice for any service cancellations or changes.
7. Fees and Payments
All charges are in line with the current NDIS Price Guide. Billing procedures, payment methods, and any applicable cancellation policies will be clearly outlined in the individual Service Agreement.

8. Termination
Either party may end the Service Agreement with appropriate notice (typically 14 days) unless an immediate end is required due to risk, misconduct, or breach of policy.
9. Limitation of Liability
To the extent permitted by law, Encourage Equilibrium will not be held liable for any indirect or consequential losses arising from service use, except where due to negligence or breach of duty.
10. Governing Law
These terms are governed by the laws of New South Wales and applicable Commonwealth legislation.
